En el presente artículo el autor analiza el instituto del caso fortuito y la fuerza mayor en la teoría general de las obligaciones civiles y comerciales, y su problemática inserción en el contrato de trabajo. A modo de debate plantea la hipótesis que la COVID-19 no constituye prima facie un caso de fuerza mayor que pueda exonerar al empleador del cumplimiento de sus obligaciones contractuales, amén de su inexistencia en el Derecho del Trabajo.<br/><br/> |
