La pandemia causada por el COVID-19 a principios del 2020, ha motorizado en nuestro país, viejos y poco usados artículos del Código Penal para imputar y, eventualmente castigar, a personas que propaguen la enfermedad o bien incumplan las normas de aislamiento que se les impongan -precisamente- para evitar dichos contagios. El autor hace un análisis de estos delitos de peligro indeterminado, que si bien afectan a un derecho individual, este se convierte en social por ser peligroso para todos. |
