Luego de la puesta en marcha de los profundos cambios implementados por el Código Civil y Comercial en materia de protección de los derechos de las personas con discapacidad o capacidad restringida, el autor analiza la cuestión relativa al acceso a la justicia efectiva (derecho a ser oído), teniendo en cuenta las Reglas de Brasilia y un reciente precedente jurisprudencial que, al disponer la restricción del pleno ejercicio de la capacidad jurídica de una mujer de 45 años por afectación de su salud mental, introdujo en la sentencia párrafos en formato de "fácil lectura", dirigidos a la destinataria de la resolución.<br/> |
